Subject: Request for written reasons for dismissal - [Your name]
Dear [Name], I was told on [date] that my employment would end on [date]. Under the Employment Relations Act 2000, I request a written statement of the reasons for my dismissal, including the reasons for selecting me for redundancy if that is what happened. Please provide this within 14 days of this request. Kind regards, [Your name]
Tips
- You can ask for reasons in writing within 60 days of learning of the dismissal. The employer must reply in writing within 14 days.
- The reasons help you decide whether to raise a personal grievance. Do not wait for the reply if you are close to the 90-day grievance deadline. Raise the grievance and keep asking.
- If the employer does not provide reasons, the Employment Relations Authority may accept a late grievance in exceptional circumstances (an employer refusing to give a reason is one example listed by Employment New Zealand). Do not rely on this: raise the grievance within the 90 days if you can, and get advice.
- Keep a copy of everything you send (sent-email folder, a screenshot or a photocopy) and save replies in one folder named with the date.
